Urgent: Independent Chair for Disability Disciplinary

Urgently seeking an independent, HR-informed chair for a two-way disciplinary looking at a complaint of failure to make reasonable adjustments for disability, and a counter-complaint about the steps the disabled person took as an alternative ‘adjustment’.

Each complainant has nominated one person each to sit on the decision making panel, and we need an independent chair.

Small organisation, so complainants (or their advocates) are compiling their own cases to be presented to the panel, rather than a full investigation (complaints are narrow and most of the facts are not disputed, the interpretation of those facts is the main issue).

We did have an independent consultant appointed, but they did not want follow the procedure agreed, and sought to change & lengthen it, while not responding to or acknowledging requests for reasonable adjustments in the process. That HR consultant seems likely now be one of the complainant’s nominated panel members.

The process needs to run on full transparency with every piece of correspondence (including this request) and transcript of the decision-making panel’s full deliberations, shared with both complainants.

The disability most relevant to the issues is epilepsy that is exacerbated by stress, and both complainants are neurodivergent.
